Eu Trademark Registration

Eu trade mark refers to a mark registered by the European Internal Market Coordination Authority (OHIM) in accordance with the conditions stipulated in the European Trade Mark Regulation (CTMR) and valid in the 25 eu countries for the identification and differentiation of goods or services.

The 25 member states of the European Union include:

France, Germany, Italy, Belgium, Netherlands, Luxembourg, Denmark, Ireland, United Kingdom, Greece, Spain, Portugal, Austria, Finland, Sweden, Cyprus, Czech Republic, Estonia, Hungary, Lithuania, Latvia, Malta, Poland, Slovakia and Slovenia.

An overview of trademark registration in the European Union

Eu trademarks and their registration applications are valid throughout the EU, and trademark applications and their corresponding registration are automatically extended to all 25 Member States. The registration of trademarks in the Eu has a registration process controlled by OHIM without the intervention of individual national industrial property offices.

Advantages: one application at a time is required. Any use in any member state shall be deemed to be used in 25 countries, and any transfer, alteration or extension of the trademark shall take effect in 25 countries; Registration costs are low, regardless of registration, renewal, etc., are much cheaper than the cost of country-by-country registration.

Requirements and documents required for EU registration

1. Applicant qualifications:

No basic registration requirements; Any natural or legal person in the country wishing to obtain trademark protection in the Eu.

2. Required Documents:

A. Power of attorney (provided by the company, signed and sealed by the applicant);

B. One copy of business license or personal ID card;

C. Name and address of applicant in English and Chinese;

D. Categories and names of goods/services to be protected;

E. Trademark drawings.

3. The exclusive right to use a trademark shall be valid for ten years from the date of application, and shall be valid for ten years for each renewal of registration.
